Terms & Conditions
OUR SERVICES
BE Top of Mind Marketing provides social media management and content creation services, including content planning, creation, caption writing, scheduling and publishing.
Your monthly package will determine the level of service you receive.
TIER 1 – £99 PER MONTH
Your package includes:
• Up to 12 social media posts per month
• Content for your agreed social media platforms
• Caption writing
• Scheduling and publishing
• Basic content planning
• Use of photographs, videos and other materials you provide
• Promotion of relevant events, offers and business activities
Tier 1 does not include recurring weekly theme posts.
TIER 2 – £149 PER MONTH
Includes everything in Tier 1, plus:
• Up to 3 recurring theme posts per week
Examples of recurring themes could include Sunday Roast, Quiz Night, Staff Spotlight, Cocktail of the Week or Friday Entertainment.
TIER 3 – £199 PER MONTH
Includes everything in Tier 1, plus:
• Up to 5 recurring theme posts per week
Recurring themes will be agreed with you as part of your content planning.
WHAT ARE RECURRING THEME POSTS?
A recurring theme is a regular weekly piece of content based around an agreed topic.
The maximum included is:
• Tier 1 – 0 recurring themes
• Tier 2 – Up to 3 recurring themes per week
• Tier 3 – Up to 5 recurring themes per week
The exact content and posting schedule may vary depending on the information, photographs and promotional material provided.
YOUR CONTENT
You'll provide the photographs, videos, logos, promotional information and other materials we need to create your content.
You confirm that you have permission to use any content you provide to us.
If we don't receive suitable content or information, this may affect our ability to create or publish certain posts.
EVENTS & PROMOTIONS
We'll happily promote things such as:
• Live music
• Quiz nights
• Sunday roasts
• Food and drink offers
• Special events
• Seasonal promotions
Please provide accurate information and reasonable notice so we can include these in your content schedule.
Last-minute requests cannot always be guaranteed.
SOCIAL MEDIA ACCESS
You'll remain the owner of your Facebook, Instagram and other social media accounts.
You'll provide us with the appropriate access required to manage your accounts. Where possible, we'll use the platform's business/delegated access rather than requiring your personal passwords.
Your account access will only be used to provide the agreed service.
CONTENT APPROVAL
Where content requires your approval, please review it promptly.
Delays in approval may result in content being published later than planned.
Once you have approved content, responsibility for the accuracy of the information provided remains with you.
THIRD-PARTY SOFTWARE & FREELANCERS
We may use third-party software, platforms, freelancers or subcontractors to help deliver your service.
This may include scheduling software, design software, cloud storage and freelance content creators.
We remain responsible for managing the service provided to you.
SOCIAL MEDIA RESULTS
Our aim is to provide you with a consistent, professional and relevant social media presence.
However, we cannot guarantee specific results such as:
• Increased followers
• Increased engagement
• Increased bookings
• Increased sales
• Increased footfall
• Viral content
• Increased revenue
Social media performance is affected by many factors outside of our control.
MONTHLY PAYMENT
Your monthly subscription will be:
• Tier 1 – £99 per month
• Tier 2 – £149 per month
• Tier 3 – £199 per month
Your subscription will automatically renew each month unless cancelled.
CANCELLATION
You can cancel your subscription at any time by providing 14 days' notice.
Cancellation requests should be made in writing by email or through our designated cancellation process.
If your cancellation is received less than 14 days before your next scheduled payment, the next payment may still be collected and your service will continue until the applicable cancellation date.
FAILED PAYMENTS
If a payment fails, we'll contact you to arrange payment.
We reserve the right to pause your service where payments remain outstanding.
REFUNDS
Payments for work already undertaken, content already created or services already provided are generally non-refundable.
Nothing in these terms affects any legal rights that cannot legally be excluded.
YOUR RESPONSIBILITIES
You agree to:
• Provide accurate information
• Provide suitable photographs and videos where required
• Provide details of upcoming events and promotions
• Ensure information supplied for publication is accurate
• Ensure content you provide doesn't infringe someone else's rights
• Provide appropriate social media access
• Notify us of relevant changes to your business
CONTENT OWNERSHIP
You retain ownership of photographs, videos, logos and other materials you provide.
BE Top of Mind Marketing retains ownership of its own templates, systems, processes and proprietary materials.
You give us permission to use your supplied content to provide the agreed service.
PORTFOLIO USE
Unless you tell us otherwise in writing, we may use publicly available examples of work created for your business as part of our portfolio and marketing.
We won't publicly disclose confidential business information.
CONFIDENTIALITY
Both parties agree to keep commercially sensitive information confidential unless disclosure is required by law.
DATA PROTECTION
Both parties agree to comply with applicable UK data protection legislation.
Where we process personal data on your behalf, appropriate data protection arrangements will be maintained where required.
LIABILITY
We'll provide our services with reasonable care and skill.
To the extent permitted by law, we aren't liable for indirect or consequential losses, loss of profit, loss of revenue, loss of business or loss of opportunity arising from the use of our services.
Nothing in these terms limits or excludes liability where doing so would be unlawful.
SUSPENSION OR TERMINATION
We reserve the right to suspend or terminate services where:
• Payments remain outstanding
• Unlawful or inappropriate content is provided
• There is abusive or threatening behaviour towards us or our contractors
• Continuing to provide the service would breach applicable law or platform rules
• These Terms are materially breached
EVENTS OUTSIDE OUR CONTROL
We aren't responsible for delays or failures caused by circumstances outside our reasonable control, including social media platform outages, internet failures, technical failures, illness, natural disasters or other events beyond our control.
AGREEMENT
By purchasing a package, making payment, completing the subscription process or instructing BE Top of Mind Marketing to begin work, you confirm that you have read and agreed to these Terms & Conditions.
